Terms of Use

Last updated: November 5, 2026. Effective: November 5, 2026.

1. Agreement

These Terms of Use are a contract between you and Mixtropolis, a pre-launch project based in Fort Worth, Texas ("Mixtropolis," "we," "us"). They cover the website at mixtropolis.com (the "Website") and the Mixtropolis mobile app (the "App"), together the "Service."

By submitting a form on the Website, creating an account in the App, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms include an arbitration agreement and a class action waiver in Section 8. They affect how disputes are resolved. Please read them.

2. Who can use the Service

You must be at least 18 years old. By using the Service you confirm that you are. You are responsible for your account and for everything that happens under it, and for keeping your sign-in email secure.

3. What Mixtropolis is

Mixtropolis is a service for discovering restaurants, bars and other places through mixes curated by hospitality professionals. Mixes, profiles, notes and recommendations are the opinions of the people who post them, not ours.

The Website lets hospitality professionals ask to claim a profile and lets diners join a waitlist. Submitting a form does not create an account or guarantee a profile. We review professional requests by hand and may decline any request without giving a reason. The profiles, people, venues and content shown on the Website are examples created to show how the App works. They do not depict real people or real reviews.

Accuracy. We do not guarantee that any information on the Service is accurate, current or complete, including hours, menus, prices, availability, awards or a professional's role or workplace. Check with the venue before you go.

4. Your content

You own it. You keep ownership of everything you post: profile details, mixes, notes, happenings, photos and menus ("Your Content").

License to us. So we can run the Service, you give Mixtropolis a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt (for example, to resize a photo), display and distribute Your Content in the App, on the Website, and in materials that promote the Service. This license ends when you delete the content or your account, except for content others have already shared or saved, and copies kept for legal or security reasons.

Your promises. You promise that you own Your Content or have the rights needed to post it, including the rights to any photo (a headshot is usually owned by the photographer, not the subject), and that posting it does not break any law or anyone's rights.

Professional profiles. If you hold a professional profile, your name, role, workplace, credentials and awards must be true and current. Your notes and mixes must be your own honest, first-hand opinion. If you are paid by, employed by, or have a financial interest in a venue you recommend, or if you are a founder, employee or contractor of Mixtropolis, you must say so on your profile or in the note. We may remove content that misrepresents anyone or hides a connection.

5. Rules

Mixtropolis has no tolerance for objectionable content or abusive users. You may not:

  • Post content that is unlawful, hateful, harassing, threatening, sexually explicit, violent or deceptive, or that infringes anyone's rights.
  • Harass, impersonate, stalk or abuse other people, or post anyone's private information.
  • Post false factual claims about a venue or a person, or reviews you were paid for without saying so.
  • Use the Service for anything commercial that we have not agreed to, including advertising, recruiting lists or data scraping.
  • Use bots, scrapers or automated tools, probe or interfere with the Service, or try to get around any access control.
  • Copy, sell or redistribute the Service or its content, or use it to build a competing product.

Reporting and blocking. You can report any profile, mix or happening from within the App, and you can block any user. We review reports and act on them within 24 hours. We may remove content and suspend or end accounts that break these Terms, with or without notice.

Ending your use. You can stop using the Service at any time and delete your account in the App. We may suspend or end your access at any time if you break these Terms, if the law requires it, or if we shut the Service down. Sections 4, 6, 7, 8 and 9 survive the end of your use.

6. Copyright, venues and third parties

Copyright complaints. If you believe content on the Service infringes your copyright, email tringa@mixtropolis.com with: a description of the work, where the content is on the Service, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that you are the owner or authorized to act for the owner, and your signature. We remove infringing content and end the accounts of repeat infringers.

Venues and businesses. Mixtropolis is independent of the restaurants, bars and venues shown on the Service. Venue names are used only to identify them. A venue's appearance on the Service does not mean it endorses Mixtropolis, and nothing on the Service is an endorsement by Mixtropolis of any venue. A venue that wants a factual correction, or to be removed from a place page, can email tringa@mixtropolis.com.

Other users and businesses. We are not responsible for the conduct of other users, or for what happens when you visit a venue, meet someone, or share your business card. Any dealings you have with a venue, a professional or another user are between you and them.

Links. The Service may link to other websites. We do not control them and are not responsible for their content or practices.

7. Disclaimers, limitation of liability and indemnification

No warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY CONTENT IS ACCURATE OR RELIABLE. THE SERVICE IS A PRE-LAUNCH PRODUCT AND MAY CHANGE OR END AT ANY TIME.

Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, MIXTROPOLIS AND THE PEOPLE WHO RUN IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, THESE TERMS, OR THE CONDUCT OF ANY USER OR VENUE, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some states do not allow some of these limits; in those states, our liability is limited to the smallest amount the law allows.

Indemnification. You will defend, indemnify and hold harmless Mixtropolis and the people who run it from any claim, loss, liability, damage, cost or expense, including reasonable attorneys' fees, that arises from Your Content, your use of the Service, your breach of these Terms, or your violation of any law or of anyone's rights. We may take over the defense of any claim you are required to indemnify, and you will cooperate with us.

8. Disputes

Talk to us first. Before starting any formal proceeding, email tringa@mixtropolis.com with a description of the problem and what you want us to do. We will try to resolve it informally within 60 days.

Arbitration. If we cannot, you and Mixtropolis agree that any dispute arising from or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator can award the same relief a court could, but only to you individually. Arbitration will take place in Tarrant County, Texas, or by video or phone if you prefer. The Federal Arbitration Act governs this section. Either of us may instead bring an individual claim in small claims court if it qualifies.

Class action waiver. YOU AND MIXTROPOLIS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable for a particular claim, that claim will proceed in court, not arbitration, and the rest of this section still applies.

Opt-out. You can opt out of this arbitration agreement by emailing tringa@mixtropolis.com within 30 days of first agreeing to these Terms, with your name, the email you signed up with, and a statement that you opt out. Opting out does not affect any other part of these Terms.

Governing law and venue. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute not subject to arbitration will be brought only in the state or federal courts located in Tarrant County, Texas, and you consent to their jurisdiction.

Time limit. Any claim related to the Service must be started within one year after it arises, or it is permanently barred, where the law allows.

9. Changes and general terms

Changes. We may update these Terms. The date at the top shows the current version. For significant changes, we will post a notice on the Website and ask you to agree again before you continue using the App. Using the Service after a change means you accept the new Terms.

Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and Mixtropolis about the Service. If any part is found unenforceable, the rest still applies. If we do not enforce a term, we can still enforce it later. You may not transfer these Terms; we may transfer them to a successor of Mixtropolis.

Apple and Google. If you downloaded the App from the Apple App Store or Google Play, those stores are not parties to these Terms and have no obligation to support the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Notices. We may send notices to the email address on your account. You can send notices to tringa@mixtropolis.com.
